Newsletter Checked On Checkout V4.2.2

I am having a heck of a time getting the newsletter do be checked by default on checkout with v4.2.2 .



I edited design/themes/responsive/templates/addons/news_and_emails/hooks/checkoutextra_payment_info.pre.tpl



I added checked=“checked” to the input but now if I uncheck it re-checks itself.



Any ideas?
