EU Directive on Cookies

Guys & Gals,



Do anyone knows is Cs-cart comply with the new Directive from the EU that will be roll out on the 26th May 2011?

Hello michaelchankh,



There is no secure or private information in the cookies, which are used by CS-Cart. It is just the user identifier.



So you will not have the problems.

In the guidance it says:



(2) The requirements are that the subscriber or user of that terminal equipment–

(a) is provided with clear and comprehensive information about the purposes of the storage of, or access to, that information; and

(b) has given his or her consent.



This suggests to me that regardless of why the cookie is being used the visitor has to agree to it’s use… can you clarify this from your end please?

Have been doing a bit of reading on this today and it would seem that:-


  1. Cookies are deemed to be essential for online shopping carts and do not fall under this directive unless they are also collecting information about where customers go once they leave the site.


  2. Many ads and tracking systems like Google Analytics do use cookies to store information and these do fall under the directive.


  3. There is a general feeling among experts and business advisors that this will not be welcomed by internet users who will resent being innundated with popups and check boxes in order to browse the internet and that it will either be abandoned or (more likely) the browser makers will develop technology so that consent is handled by the browser.


  4. Many experts are also warning small businesses not to put messages etc on their sites too soon due to the possibility/liklihood of 3 above.


  5. In the UK we have a 12 month period before the law is fully effective not sure about other countries but it may well be the same or similar.

Just do anyone have any firm answer on this subject about handling cookies? Will Cs-Cart able to let us in EU countries have something similar to what ICO did on their website?
