We are official partners with SagePay, and we take part in their affiliate program. This is a common worldwide practice. Such approach allows us to recoup expenses for supporting the SagePay payment module integration.

This code does not affect you commissions.

So I'm not sure what is this mess about? Can you explain why is this untrustworthy for you?

Once again. We are official partners of SagePay: http://www.sagepay.co.uk/partners-and-developers/partners-programme, which is successfully operates in UK and EU, without braking any laws. We do not receive any kind of you personal data because its official partner program.
So if you think that having partner code in the gateway integration can somehow affect your business or privacy you are free to contact SagePay directly.
